              Fire Replacement 
              In the event this file 
              is damaged by fire while in the possession of the original purchaser 
              as shown on the warranty registration card, Schwab warrants that 
              it will replace the file free of charge, however all freight costs 
              are to be borne by the purchaser. 
            Lifetime 
              File Parts 
              Schwab warrants that it 
              will repair or replace, at Schwab’s option, any file part 
              manufactured by Schwab, that fails in normal use as a result of 
              defects in materials or workmanship, free of charge except for shipping 
              and handling charges for as long as the original registered purchaser 
              owns the file. 
            Labor 
              Schwab will furnish the 
              labor associated with any defective part replacement for a period 
              of two years from the date of purchase. All such labor charges must 
              be authorized in advance by Schwab in writing. All labor will be 
              performed at service centers or by service providers designated 
              by Schwab. 
            Parts 
              Manufactured by Others 
              Schwab does not warrant 
              any product, components or parts, such as locks, not manufactured 
              by Schwab, however, to the extent that the manufacturer provides 
              a warranty and the warranty is assignable, Schwab hereby assigns 
              that warranty to the purchaser. 
            Disclaimer 
              of Warranty 
              THIS WARRANTY IS LIMITED 
              TO THE TERMS STATED HEREIN. IT IS IN LIEU OF AND SUPERSEDES ANY 
              OTHER WARRANTY WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY 
              OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. 
            Limitation 
              of Remedies 
              In no case shall Schwab 
              be liable for any special, incidental, or consequential damages 
              based upon breach of warranty, breach of contract, negligence, strict 
              tort, or any other legal theory. Such damages include, but are not 
              limited to, loss of profits, loss of savings or revenue, loss of 
              use of the file or any associated equipment, loss of the contents 
              of the file, cost of capital, cost of any substitute equipment, 
              facilities or services, downtime, the claims of third parties including 
              customers, and injury to property. Some states do not allow limits 
              on warranties, or on remedies for breach in certain transactions. 
              In such states, the limits in this paragraph and in the prior paragraph 
              may not apply. 
            Warranty 
              Registration Card 
              It is a requirement of 
              this warranty that the registration card showing the serial number 
              of the file and original purchaser information must be on file with 
              Schwab within sixty (60) days of purchase to validate this warranty. 
              Failure to register the product and original purchaser shall void 
              any warranty. 
            No 
              Other Warranties 
              Unless modified 
              in writing signed by both parties, this agreement is understood 
              to be the complete and exclusive agreement between the parties, 
              superseding all prior agreements, oral or written, and all other 
              communications between the parties relating to the subject matter 
              of this agreement. No employee of Schwab or any other party is authorized 
              to make any warranty in addition to those made in this agreement. 
            Allocation 
              of Risks 
              This warranty allocates 
              the risks of product failure between Schwab and the purchaser. This 
              allocation is recognized by both parties and is reflected in the 
              price of the goods. The purchaser acknowledges that it has read 
              this agreement, understands it, and is bound by its terms.  |
